Más 1 millón 400 mil trabajadores se beneficiarán de la aplicación del aumento salarial mínimo de las empresas no sectorizadas

El Horizonte, Santo Domingo, RD. – 1, 490,894 trabajadores serán beneficiados con la nueva reclasificación respecto del aumento salarial mínimo, respondiendo a la Ley 187-17, según informó el Ministerio de Trabajo por los datos arrojados a través del Sistema Integrado de Registro Laboral (SIRLA).

Según indica la entidad la reconfiguración del tejido laboral tuvo una variación de un 49% a un 52%  referente al número de trabajadores que pertenecen a las grandes empresas, mientras que los que pertenecen a las medianas empresas incrementaron de un 7% a un 15%; en relación a las pequeñas se redujo de un 44% a un 21%, y las microempresas tuvieron una variación de un 0% a un 13%, debido a que en las reclasificaciones anteriores las microempresas no eran valoradas para la realización de ajustes salariales mínimos.

Se recuerda que son consideradas microempresas aquellas que tienen de 1 a 10 empleados  o que registran una venta bruta anual de hasta 8 millones de pesos; pequeñas empresas aquellas que tienen un rango de activos de 8 a 54 millones de pesos y de 11 a 50 empleados; En cuanto a las medianas son aquellas conformadas por unos 51 a 150 empleados, o registran una venta bruta anual de 54 a 202 millones de pesos, y finalmente las grandes son aquellas conformadas por más de 151 empleados y su venta bruta anual sobrepasa los 202 millones de pesos. 

Según explica la entidad, las empresas reclasificadas como grandes o medianas y sus trabajadores están salvaguardados por los derechos laborales. “En el centro de nuestra gestión está el modernizar y reorganizar la dinámica laboral dominicana, en miras de generar más y mejores empleos, impulsar nuevas oportunidades y capacitar el talento dominicano para acelerar su desempeño laboral y su calidad de vida” agregó el ministro de Trabajo, Luis Miguel De Camps.

Indica que en el artículo 2 de la resolución CNS 01-21 y en el principio VII del Código Laboral, In dubio pro-operario, en caso de que una empresa cumpla con criterios de escala diferentes en ventas y número de trabajadores, se tomará como predominante el de la escala superior para su clasificación y consecuente salario mínimo aplicable.

Así mismo se prohíbe la reducción de salarios como la desvinculación y recontratación de trabajadores con el fin de pagar salarios menores a los devengados por los trabajadores, establecidos en el artículo 4 de esta, y en el artículo 217 del Código Laboral.
